This Privacy Notice (hereinafter referred to as the “Notice”) establishes the terms and conditions under which Aerotransportes Mas de Carga, S.A. de C.V. hereinafter referred to as “MasAir” with address for hearing and receiving notifications at Hangar 9, Zona C, Zona de Hangares, Zona Federal, Aeropuerto Internacional de la Ciudad de México, Ciudad de México, México, C.P. 15520, in its capacity as “Controller” will process any information concerning an identified or identifiable natural person, hereinafter referred to as the “personal data” of the “Holder”.
For the purposes of the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDP”) and other applicable legislation, the Owner declares (i) that this Notice has been made known to him/her by MasAir, (ii) that he/she has read, understood and agreed to the terms set forth in this Notice, and therefore gives his/her consent to the processing of his/her personal data. In the event that the personal data collected includes financial or property data, by signing the corresponding contract, either in printed format or using electronic means and its corresponding processes for the formation of consent, acts will be carried out that constitute the express consent of the Owner and (iii) that he/she gives his/her consent for “MasAir” or the natural person(s) or legal person(s) who alone or jointly with others process such personal data on behalf of MasAir (hereinafter “Processors”), to carry out transfers and/or remissions of personal data in terms of section 6 of this Notice.
“MasAir” may collect personal data from the Owner through direct and/or personal delivery by any means of contact between the Owner and MasAir or its Managers, including electronic means. It may also collect personal data indirectly through publicly accessible sources and other sources available on the market.
“MasAir”, depending on the services it provides to the Owner, may collect personal identification data, location data and financial and/or property data. Location data shall be understood as information that identifies your approximate location through the use of longitude and latitude coordinates obtained through GPS, Wi-Fi or location triangulation of a mobile terminal equipment. In addition, academic, work data and sensitive personal data related to physical, personal characteristics and biometric data may be collected exclusively as necessary for the provision of the services requested by the Owner to MasAir.
MasAir may process personal identification and contact data of third parties to validate the information that the Owner has provided us and, where appropriate, provide the corresponding benefits when it comes to beneficiaries. By providing this information, you acknowledge that you have informed said third parties about the use of their data and have previously obtained their consent.
Primary Purposes: (a) Manage and resolve any complaints or claims submitted; (b) Verify the identity of the claimant and the information provided to ensure the legitimacy of the claim; (c) Integrate and update the claimant's file in our database related to the claim; (d) Manage and operate the services and products involved in the claim; (e) Communicate the status and decisions regarding claims through emails, phone calls and other appropriate means of communication; (f) Comply with applicable legal and regulatory obligations in the management of claims.
Secondary Purposes: (a) Improve our services and the user experience in the management of claims; (b) Evaluate the quality of the service and conduct internal studies on consumption habits and satisfaction.
The owner of the personal data has the right to object to the use of his/her personal data for the secondary purposes mentioned above. To exercise this right, he/she must follow the procedure established in this privacy notice, within 5 business days after it becomes available.
In addition, you can exercise your ARCO rights (access, rectification, cancellation or opposition) regarding the personal data processed within the framework of the claims platform. If you do not object within five business days after your data is collected, it will be understood that you have given your consent.
Security Measures: The claims management platform has technical, physical and administrative security measures to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or processing.
5. LIMITATION OF USE OR DISCLOSURE OF PERSONAL DATA.
To limit the use or disclosure of your personal data, you or your duly accredited legal representative may send a request by email to the address:

It is important to consider that, by limiting the use of your personal data, you may not have access to the additional benefits offered for our secondary purposes.
“MasAir” will retain the personal data of the Holder for the time necessary to process your requests for information, products and/or services and claims, as well as to maintain accounting, financial and audit records in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDP) and applicable commercial, fiscal and administrative legislation.
Appropriate administrative, technical and physical security measures will protect personal data against damage, loss, alteration, destruction or unauthorized access or processing, in line with the provisions of the LFPDP and other applicable legislation. However, “MasAir” cannot guarantee that unauthorized third parties cannot access the physical or logical systems of the Owners or MasAir, or the electronic documents and files stored. Therefore, “MasAir” will not be liable for any damages that may arise from such unauthorized access.
If you consider that your right to the protection of personal data has been violated by “MasAir”, you may file a complaint with the National Institute for Transparency, Access to Information and Protection of Personal Data (“INAI”).
6. TRANSFERS AND/OR REFERRALS OF DATA.
“MasAir” requires to remit, and/or allow access to the personal data of the Owner in order to comply with its legal and/or commercial obligations, as well as to carry out an adequate management of the claims presented, for which it has entered into or will enter into various legal agreements.
The recipients of the personal data are obliged by virtue of the corresponding contract to maintain the confidentiality of the personal data provided and to observe this Notice. “MasAir” may communicate the personal data collected, for the services provided to the Owner as the specific situation warrants, but always under the premise that said transmission will have the same purposes described in this Notice.
7. PROCEDURE TO EXERCISE ARCO RIGHTS AND REVOCATION OF CONSENT.
The Owner has, at all times, the right to access, rectify and cancel his/her data, as well as to oppose the processing of the same or revoke the consent he/she has provided by submitting an express request, which must contain the following information and documentation:
a. Name of the Owner and address or other means to communicate the response to his/her request;
b. The current documents that prove your identity (simple copy in printed or electronic format of your voter ID, passport or any other official identification document) or, where applicable, the legal representation of the Holder (simple copy in printed or electronic format of the simple power of attorney with the autograph signature of the Holder, the agent and their corresponding current official identifications – voter ID, passport or any other official identification document);
c. The clear and precise description of the personal data in respect of which you seek to exercise any of the ARCO rights, and
d. Any other element or document that facilitates the location of the Holder's personal data.
In the case of requests for rectification of personal data, the Holder must also indicate the modifications to be made and provide the documentation that supports his/her request. In order to comply with the obligation to access your personal data, prior accreditation of the identity of the owner or the personality of the representative; making the information available on site or at the address of MasAir. Another means may be agreed between the Owner and MasAir provided that the requested information allows it.
To request the format, reception, and response to requests to exercise your ARCO rights, the revocation of your consent and the other rights provided for in the LFPDP, we make the following means available to you:

In the event that the information provided in your request is incorrect or insufficient, or the corresponding accreditation documents are not included, we may request, within five business days following receipt of the request, that you provide the elements or documents necessary to process it. The Owner will have ten business days to respond to the request, counted from the day after receiving it. If no response is provided within this period, the corresponding request will be deemed not to have been submitted. “MasAir” will respond to the Owner within a maximum period of twenty business days, counted from the date on which the request was received in order to, if appropriate, make it effective within fifteen business days following the communication of the response. In all cases, the response will be given by the same means by which you submitted your request or, where appropriate, by any other means agreed with the Owner. The aforementioned deadlines may be extended in terms of the LFPDP.
In the event of exercising the right of access, the means by which you may obtain the requested information or personal data will be in simple copies or electronic documents (which will be sent to the email indicated in your request). MasAir may deny access to personal data, or make rectification or cancellation or grant opposition to the processing of the same.
8. USE OF COOKIES.
We use cookies to improve our services and show you advertising related to your browsing preferences and the content of your previous visits. When you visit MasAir websites again, cookies may allow us to personalize our content according to your preferences.
Please note that MasAir websites do not use or store cookies to obtain personally identifiable data from your computer that was not originally sent as part of the cookie. Although most browsers accept cookies, the owner can configure his browser to not accept them. These technologies can be disabled by following the procedures for each browser, however, you should take into account that disabling them could limit the functionality offered by the platform.
9. CHANGES TO THE NOTICE.
This Privacy Notice may be modified and/or updated at any time by MasAir, to address legislative or jurisprudential reforms, internal policies, or new requirements, with the updated version being the one published on our website [*].
In the event that MasAir changes its identity, requires collecting additional personal, financial or patrimonial data, changes the purposes for obtaining your personal data or modifies the conditions of the transfers that may be carried out under the provisions of this Privacy Notice, a new privacy notice will be made available to the data owners through the email address that the owner has provided to MasAir or through the MasAir website.
